BrushUpIQ is operated by Deeray Multimedia Ltd, a company registered in England and Wales under company number 12586799, with its registered office at 20-22 Wenlock Road, London, England, N1 7GU. References to "we", "us" or "our" in these Terms mean Deeray Multimedia Ltd as operator of BrushUpIQ.

These Terms of Service govern your access to and use of BrushUpIQ, including our website, web app, quiz generation tools, account features and related services.

By creating an account, using BrushUpIQ, uploading content or generating quizzes, you agree to these Terms. If you do not agree, please do not use the service.

1. About BrushUpIQ

BrushUpIQ is an AI-powered quiz generation platform that helps users convert learning materials, documents, notes and training content into quizzes for study, revision, assessment preparation and knowledge checking.

BrushUpIQ may generate:

Multiple-choice questions
True/False questions
Multiple-answer questions
Explanations and learning prompts
Quiz results and progress summaries

The service is designed to support learning. It is not a replacement for professional teaching, formal assessment, legal, medical, financial or academic advice.

2. Who Can Use BrushUpIQ

You may use BrushUpIQ if you are able to enter into a binding agreement or have permission from a parent, guardian, school, employer or authorised organisation.

If you use BrushUpIQ on behalf of a business, training provider, school, college, organisation or client, you confirm that you have authority to accept these Terms on their behalf.

You must not use BrushUpIQ if you are legally prohibited from using the service in your country or region.

3. Your Account

To use certain features, you may need to create an account.

You agree to:

Provide accurate registration information
Keep your login details secure
Not share your account with unauthorised users
Notify us if you believe your account has been compromised
Be responsible for activity that happens under your account

We may suspend or restrict your account if we reasonably believe it has been misused, compromised or used in breach of these Terms.

BrushUpIQ allows users to upload or input learning content and generate AI-supported quizzes.

Depending on your plan, features may include:

Future creator, team and enterprise features

We may update, improve, restrict, suspend or discontinue parts of the service from time to time. Where reasonably possible, we will try to avoid disruption to active users.

5. Plans, Usage Limits and Paid Features

BrushUpIQ may offer free and paid plans.

Each plan may include different limits, such as:

Number of quiz generations per month
Number of questions per quiz
File upload size limits
Access to specific question types
Quiz history
Export options
Team or business features

Free plans are provided for testing, trial and personal use. Paid plans may unlock additional functionality.

We may change plan limits, features or prices from time to time. If you are on a paid subscription, we will aim to give reasonable notice of material pricing changes before they affect your renewal.

You must not attempt to bypass plan limits, usage restrictions, file limits or credit controls.

6. Payments, Subscriptions and Cancellation

If you purchase a paid plan, you agree to pay the fees shown at checkout.

Paid plans may be billed monthly or annually, depending on the option selected.

Unless stated otherwise:

Subscription fees are charged in advance
Your subscription may renew automatically
You can cancel future renewals through your account settings or by contacting us
Cancelling a subscription stops future billing but does not automatically refund previous charges

Any refund rights will depend on your location, consumer status, payment method, applicable law and the nature of the digital service already provided.

Nothing in these Terms affects any legal rights you may have under applicable consumer protection laws.

7. Your Content

“Your Content” means any documents, text, notes, files, prompts, quiz topics or other material you upload, submit or provide to BrushUpIQ.

You retain ownership of Your Content.

By using BrushUpIQ, you grant us the limited permission needed to process Your Content in order to provide the service, including extracting text, generating quiz questions, creating explanations, saving quiz history where applicable, and displaying results to you.

You confirm that you have the right to upload and use Your Content.

You must not upload content that:

You do not have permission to use
Infringes copyright, trademarks, privacy rights or other rights
Contains unlawful, harmful or abusive material
Contains highly confidential, restricted or sensitive information unless you are authorised to process it
Contains personal data you are not permitted to upload
Contains malware, viruses or malicious code

If you are using workplace, client, school or organisational documents, you are responsible for ensuring that you have permission to upload and process those documents.

8. Privacy and Document Handling

BrushUpIQ is designed with a privacy-first approach.

Where possible, document text extraction may happen locally in your browser. This means your original file may not need to be stored by BrushUpIQ in order to generate a quiz.

However, to generate AI-powered questions and explanations, extracted text, prompts and related quiz information may need to be processed by BrushUpIQ systems and/or trusted AI service providers.

You should not upload highly sensitive personal data, confidential client information, regulated information or restricted business documents unless you have the legal right and organisational approval to do so.

9. AI-Generated Content

BrushUpIQ uses artificial intelligence to generate quiz questions, answers, explanations and learning support content.

AI-generated content may be inaccurate, incomplete, outdated, misleading or unsuitable for your specific purpose.

You are responsible for reviewing and verifying generated content before relying on it.

You should always compare AI-generated questions and explanations against the original source material, especially for:

Exams
Professional certifications
Workplace training
Compliance learning
Medical, legal, financial or technical topics
Formal assessments

BrushUpIQ does not guarantee that generated quizzes will be error-free, exam-ready, complete, or suitable for any specific qualification, course or professional requirement.

10. Acceptable Use

You agree not to misuse BrushUpIQ.

You must not:

Upload illegal, infringing or harmful content
Use the service to create misleading, discriminatory, abusive or harmful material
Attempt to overload, disrupt or attack the service
Reverse-engineer, scrape, copy or replicate the service
Circumvent usage limits, paywalls or security controls
Use automated tools or bots without permission
Access another user’s account or data
Use BrushUpIQ to process content you are not authorised to use
Use the service in a way that breaches applicable law or regulation

We may investigate suspected misuse and take action where necessary.

11. Intellectual Property

BrushUpIQ, including the website, app design, branding, software, workflows, features, logos and platform content, belongs to Deeray Multimedia Ltd or its licensors.

You must not copy, modify, distribute, sell, reverse-engineer or create competing services based on BrushUpIQ without written permission.

You may use quiz outputs generated from Your Content for your own study, training or permitted educational purposes, subject to these Terms and any rights belonging to third parties in the original materials.

12. Third-Party Services

BrushUpIQ may rely on third-party service providers for features such as:

Authentication
Hosting
AI processing
Analytics
Payments
Email delivery
Security monitoring

Your use of those features may also be subject to the terms and privacy notices of those third-party providers.

We are not responsible for third-party services outside our reasonable control.

13. Availability and Changes

We aim to provide a reliable service, but we do not guarantee that BrushUpIQ will always be available, uninterrupted, secure or error-free.

The service may be unavailable due to:

Maintenance
Updates
Technical issues
Third-party provider outages
Security incidents
Events outside our reasonable control

We may update or change the service to improve performance, security, functionality or commercial viability.

14. Coming Soon Features

BrushUpIQ may include beta, or “coming soon” features.

These features may:

Change before full release
Be removed
Have limited functionality
Contain bugs or errors
Be available only to selected users or plans

You should not rely on beta or coming soon features being permanently available.

15. Termination and Suspension

You may stop using BrushUpIQ at any time.

You may request account deletion through your account settings or by contacting us.

We may suspend, restrict or terminate your access if:

You breach these Terms
Your account is used unlawfully or abusively
You attempt to bypass security or usage limits
Payment fails for a paid plan
We are required to do so by law
Continued access creates risk to BrushUpIQ, users or third parties

Where appropriate, we may give you an opportunity to resolve the issue.

16. Disclaimers

BrushUpIQ is provided on an “as available” basis.

We do not guarantee that:

The service will meet all your requirements
AI-generated content will be accurate
Quizzes will be suitable for a specific exam or qualification
The service will be uninterrupted or error-free
Any learning outcome, exam result or business outcome will be achieved

You are responsible for how you use the service and any content generated through it.

Nothing in these Terms excludes or limits rights that cannot be excluded or limited under applicable law.

17. Limitation of Liability

To the maximum extent permitted by law, Deeray Multimedia Ltd will not be liable for:

Loss of profits
Loss of business
Loss of data
Loss of goodwill
Indirect or consequential loss
Decisions made based on AI-generated content
Errors in generated quizzes or explanations
Unauthorised use of content uploaded by you without proper rights

Our total liability for claims relating to the service will not exceed the amount you paid to BrushUpIQ in the 12 months before the claim, unless the law requires otherwise.

Nothing in these Terms limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any liability that cannot legally be limited.

18. Indemnity

If you use BrushUpIQ on behalf of a business, organisation, school, client or training provider, you agree to indemnify Deeray Multimedia Ltd against losses, claims, damages or expenses arising from your misuse of the service, breach of these Terms, or unauthorised use of third-party content.

This clause does not apply to consumers where it would be unfair or unlawful under applicable consumer protection laws.

19. Governing Law

These Terms are governed by the laws of England and Wales, unless mandatory consumer protection laws in your country or region give you additional rights.

The courts of England and Wales will have jurisdiction over disputes relating to these Terms, subject to any mandatory rights you may have as a consumer.

20. Changes to These Terms

We may update these Terms from time to time.

If changes are material, we will take reasonable steps to notify users, such as by updating the website, displaying an in-app notice or sending an email.

The updated Terms will apply from the date shown at the top of the page.

If you continue using BrushUpIQ after the Terms are updated, you accept the updated Terms.
